Croatia is a transitional society in that it is a country emerging from a socialist command economy toward a market-based economy with ensuing structural changes of a social and political nature—some extending into the healthcare system. A legacy from our past is that, until now, Croatian healthcare institutions have had no real experience with clinical ethics support services. When clinical cases arise presenting complex ethical dilemmas in treatment options, the challenges presented to the medical team are substantial. The case described (...) below recently occurred on a ward in a university hospital in Croatia. An unexpected request from the patient’s parents created a number of issues that needed to be addressed by the medical team, which was made more difficult by the lack of clinical ethics support services. Such cases press the question currently being debated as to what type of ethics support services would be suitable for Croatia and why. (shrink)

In this paper we develop a general theory of algorithmic fairness. Drawing on Johnson King and Babic’s work on moral encroachment, on Gary Becker’s work on labor market discrimination, and on Strawson’s idea of resentment and indignation as responses to violations of the demand for goodwill toward oneself and others, we locate attitudes to fairness in an agent’s utility function. In particular, we first argue that fairness is a matter of a decision-maker’s relative concern for the plight of people (...) from different groups, rather than of the outcomes produced for different groups. We then show how an agent’s preferences, including in particular their attitudes to error, give rise to their decision thresholds. Tying these points together, we argue that the agent’s relative degrees of concern for different groups manifest in a difference in decision thresholds applied to these groups. (shrink)

Our time is characterized by what seems like an unprecedented process of intense global homogenization. This reality provides the context for exploring the nature and value of toleration. Hence, this essay is meant primarily as a contribution to international ethics rather than political philosophy. It is argued that because of the non-eliminability of differences in the world we should not even hope that there can be only one global religion or ideology. Further exploration exposes conceptual affinity between the concepts of (...) intolerance, ideology, and doctrinal evil. The last concept is developed in contrast to pure evil and average evil, and under the assumption of the metaphysical necessity of free will. Doctrinal evil is found to represent the main source of intolerance as a result of a mechanism that tends to confuse doctrinal evil (or the competing conceptions of the good) with pure evil. This connection between doctrinal evil and pure evil provides ideologies with their forcefulness. Tolerance cannot be properly understood in terms of a simple opposition to intolerance, however. Tolerance emerges as a sort of vigilance, conscientiousness, and non-negligence based not on a supposedly correct interpretation of the good, but rather on the acceptance of the fallibility of any such attempted definition. Conversely, the principal evil in doctrinal evil is found in arrogance that accompanies the intolerance-inducing irresponsible thoughtlessness. With this conceptual topology in mind the paper also addresses questions regarding religious tolerance, the ideology of human rights and democracy, the right to self-defense, ways to face evil, the dialectics of using old names for novel evils, and related issues. In his essay On Liberty, John Stuart Mill presents the famous harm principle in the following manner: “[…] the sole end for which mankind are warranted, individually or collectively, in interfering with the liberty of action of any of their number, is self-protection. […] The only part of the conduct of anyone, for which he is amenable to society, is that which concerns others. […] Over himself, over his own body and mind, the individual is sovereign.” Hence, there is a (...) distinction between self-regarding and other-regarding acts, and only the latter are subject to moral criticism. However, while all acts are in some way selfregarding, it is not clear if there are any which are exclusively so. There are two additional difficulties. First, the “individual” may not be an individual person; self-determining communities, at least when they have the ability to decide for themselves, are also “individuals” in this sense. Second, it is claimed that groups of acts (activities and practices) have a different kind of justification from single acts. So what are the limits which “others” have in order to protect themselves from what “individuals” (personal or not) do, and what are their rights to do and to protect? If, in the final analysis, protection or defense is a source of justification, what should or must be protected, and why? Where does the demarcation line between self-regarding and other-regarding acts lie? In our age, as in Mill’s, we encounter many situations where such a line is needed, yet is hard to determine or establish. One such example, the case of same-sex marriages, is further explored in this paper. (shrink)

We propose a model that identifies the configurations of relations between environmental practices and other management practices that can improve employee performance, measured as labor productivity. To test our model, we use the qualitative comparative analysis methodology, which allows us to demonstrate empirically how different configurations of management practices, including environmental practices, quality management systems, teamwork, and interorganizational relations, contribute to work systems in ways that increase labor productivity. Our results, based on data from 4,975 employees from 1,866 firms, show (...) that environmental practices are associated with higher labor productivity only when they are combined with other management practices. U teoriji holarhijske evolucije Kozmosa Wilber razlikuje četiri temeljna tipa holarhija, shvaćajući da ih je nemoguće svesti na jednu, osnovnu holarhiju. Mapa četiriju kvadranata ukazuje na dimenzionalnost i »dubinskost« njegove kozmologije. Pojmovi »holon« i »holarhija« ključni su pojmovi u Wilberovoj interpetaciji stupnjeva spiralnoga razvoja ljudske svijesti. U teoriji spiralne dinamike društvenoga razvoja Dona Becka i Chrisa Cowana poznati su kao »Memi« – sustavi temeljnih vrijednosti, reprezentanti beskonačnih stupnjeva progresa ili regresa. Na modelu »spiralne dinamike« Wilber interpretira stupnjevanje unutarnje transformacije koja (...) prati razvoj svijesti, posvećujući posebnu pažnju četirima stupnjevima »višega«, transpersonalnog razvoja koje još naziva »psihičkim«, »suptilnim«, »kauzalnim« i »nedvojnim«. To su razine svijesti na kojima um prestaje, a o njima svjedoče mistične, kontemplativne i jogičke tradicije. Na ovome mjestu njegova teorija postaje znanstveno neprihvatljiva i, time, problematičnaIn his theory of a holarchic evolution of Cosmos, Wilber distinguishes four fundamental types of holarchies, realizing that there is no possibility to reduce them to one, basic holarchy. The map of four quadrants indicates dimensionality and profundity of his Cosmology. Notions such as “holon” and “holarchy” represent the key notions in his interpretation of spiral evolution stages of human consciousness. In the theory of spiral dynamics of social development, created by Don Beck and Chris Cowan, they are known as “Memes”– systems of core values, the representatives of infinite stages of progress or regress. By means of a spiral dynamics model, Wilber interprets staging of the inner transformation that accompanies the evolution of consciousness, paying special attention to four stages of a “higher”, transpersonal evolution, which he also calls “psychic”, “subtle”, “causal” and “nondual” stages. These are levels of consciousness where the mind stops and which are testified by various mystic, contemplative and yoga traditions. War ethics might sound as impossible combination of words – how justify what seems to be unjustifiable? War is prima facie unjustifiable. However, wars are a fact of human reality, and those among us who are unfortunate to live in times of war – in a way it is all of us – would know that the reality is not just a possibility, that prima facie designation does not help in answering what must be done, that unjustifiability does not imply (...) impossibility. We must understand to be able to explain, and to explain to have a valid evaluation, especially when what is happening is important and with far-reaching consequences. Wars are such phenomena. We live amid such phenomena, and we need to understand not only their tragic and often cataclysmic nature, but also their meaning, their structure and logic of their functioning. We should understand that war is not something that happens only to others, nor that it is the matter of the past. In the present volume we have thirty-three essays examining war from many angles, sometimes from the opposite standpoints, exploring some of the most intriguing issues of warfare in times characterized by radical changes in the world in turmoil. The contributions in present volume give an overview of the world’s thinking about war. The volume is certainly incomplete and unfinished, but it gives a lot of thought-provoking incentives to think about the most important aspects of warfare and its broad phenomenology. (shrink)

Sanja Ivic offers a philosophical analysis of the concept of European values from the origin of this concept to the present day. This book rethinks European values in light of the various crises that the European Union (EU) has faced since 2008 and analyzes EU initiatives to create a new narrative for Europe.

The paper examines the justification of warfare. The main thesis is that war is very difficult to justify, and justification by invoking “justice” is not the way to succeed it. Justification and justness (“justice”) are very different venues: while the first attempts to explain the nature of war and offer possible schemes of resolution (through adequate definitions), the second aims to endorse a specific type of warfare as correct and hence allowed – which is the crucial part of “just war (...) theory.” However, “just war theory,” somewhat Manichean in its nature, has very deep flaws. Its final result is criminalization of war, which reduces warfare to police action, and finally implies a very strange proviso that one side has a right to win. All that endangers the distinction between ius ad bellum and ius in bello, and destroys the collective character of warfare (reducing it to an incomprehensible individual level, as if a group of people entered a battle in hopes of finding another group of people willing to respond). Justification of war is actually quite different – it starts from the definition of war as a kind of conflict which cannot be solved peacefully, but for which there is mutual understanding that it cannot remain unresolved. The aim of war is not justice, but peace, i.e. either a new articulation of peace, or a restoration of the status quo ante. Additionally, unlike police actions, the result of war cannot be known or assumed in advance, giving war its main feature: the lack of control over the future. Control over the future, predictability (obtained through laws), is a feature of peace. This might imply that war is a consequence of failed peace, or inability to maintain peace. The explanation of this inability (which could simply be incompetence, or because peace, as a specific articulation of distribution of social power, is not tenable anymore) forms the justification of war. Justice is always an important part of it, but justification cannot be reduced to it. The logic contained here refers to ius ad bellum, while ius in bello is relative to various parameters of sensitivity prevalent in a particular time (and expressed in customary and legal rules of warfare), with the purpose to make warfare more humane and less expensive. Nove tehnologije omogućavaju nove postupke i prakse koji moraju da se moralno i pravno opravdaju. IVF i surogat materinstvo, pored ostalih, spadaju u takve nove prakse. Stara pravila o tome šta je dopušteno a šta mora da se zabrani ponekad nisu dovoljna, a ni analogije obično nisu dovoljne. Da bi se došlo do prihvatljive linije razdvajanja izmedju opravdanog i neopravdanog postupanja treba izvršiti adekvatnu etičku analizu tih fenomena. IVF, tehnologija oplodnje „in vitro“, iako na prvi pogled izaziva sumnjičavost, ne sadrži (...) u sebi nikakav prima facie moralni problem. IVF se može uzeti prosto kao tehnika lečenja neplodnosti ili smanjene plodnosti, što je jedan problem koji pogadja veliki broj ljudi danas. Prigovori koji se mogu staviti ne izgledaju odlučujući a koristi koje se ovom tehnikom postižu su očigledno veoma velike. Ali ta tehnika je povezana sa druga momenta, donacijom genetskog materijala i surogat materinstvom, koji povlače razne vrste pitanja koja mogu biti od velikog moralnog i pravnog značaja. U tekstu se, sa etičkog stanovišta, analiziraju najvažnija od tih pitanja i naznačava kriterijum demarkacije koji razdvaja opravdane postupke od onih koji nisu opravdani ili zahtevaju ograničenje kroz pravnu i moralnu regulaciju. U svome spisu O slobodi, John Stuart Mill predstavlja svoje poznato načelo nenanošenja štete na sljedeći način: “… samozaštita [je] jedina svrha zbog koje se čovječanstvo, pojedinačno ili kolektivno, ima pravo miješati u slobodu djelovanja svakog od svojih članova. […] On je odgovoran društvu samo za ono svoje ponašanje koje se tiče ostalih. […] Pojedinac je neograničeni gospodar nad samim sobom, nad svojim tijelom i dušom.” Dakle, postoji razlika između postupaka koji se tiču nas samih i postupaka koji se tiču (...) ostalih, te moralnoj kritici podliježu samo postupci koji se tiču ostalih. Međutim, iako se svi postupci na neki način tiču nas samih, nije jasno postoje li bilo koji postupci koji su isključivo takvi. Postoje i dvije dodatne poteškoće. Kao prvo, ‘pojedinac’ može i ne biti pojedinačna osoba; samo-određujuće zajednice, barem kada su sposobne samostalno odlučivati, također su ‘pojedinci’ u ovome smislu. Kao drugo, tvrdi se da se klase postupaka, djelatnosti i načina postupanja opravdavaju drukčije nego pojedinačni postupci. Koje su, dakle, granice koje ‘drugi’ imaju kako bi se ‘zaštititili’ od kojih ‘pojedinaca’ te koja prava na postupanje i zaštitu oni imaju? Ako je izvor opravdanja, u konačnoj raščlambi, zaštita ili obrana, što se – i zašto – treba ili mora zaštititi? Gdje leži crta razgraničenja između postupaka koji se tiču nas samih i postupaka koji se tiču ostalih? U našem vremenu, kao i u Millovu, nailazimo na mnoge situacije u kojima je takva crta potrebna, ali je teško odrediva ili ustanovljiva. This paper contains some of the most important results obtained from surveys on domestic violence in Serbia and Macedonia, as well as from a survey on violence against women in the Federation of Bosnia and Herzegovina. These surveys have confirmed the results of other research showing that wife abuse is one of the most serious yet at the same time most hidden forms of victimization. It represents the manifestation of power and control over the victim, leading to a loss of (...) trust and a threat to safety. Bearing that in mind, the aim of this paper is to examine the prevalence, structure and some features of wife abuse in the post-war societies of the former Yugoslavia, based on an analysis of the results of these surveys, with particular emphasis on the impact of the economic crisis and war on this phenomenon. Because of its practical advantages, machine learning (ML) is increasingly used for decision-making in numerous sectors. This paper demonstrates that the integral characteristics of ML, such as semi-autonomy, complexity, and non-deterministic modeling have important ethical implications. In particular, these characteristics lead to a lack of insight and lack of comprehensibility, and ultimately to the loss of human control over decision-making. Errors, which are bound to occur in any decision-making process, may lead to great harm and human rights violations. It is (...) important to have a principled way of assigning responsibility for such errors. The integral characteristics of ML, however, pose serious difficulties in defining responsibility and regulating ML decision-making. First, we elaborate on these characteristics and their epistemic and ethical implications. We then analyze possible general strategies for resolving the assignment of moral responsibility and show that, due to the specific way in which ML functions, each potential solution is problematic, whether we assign responsibility to humans, machines, or using hybrid models. Then, we shift focus on an alternative approach that bypasses moral responsibility and attempts to define legal liability independently through solutions such as informed consent and the no-fault compensation system. Both of these solutions prove unsatisfactory because they leave too much room for potential abuses of ML decision-making. We conclude that both ethical and legal solutions are fraught with serious difficulties. These difficulties prompt us to re-weigh the costs and benefits of using ML for high-stake decisions. The paper deals with the approaches to researching music from the scientific perspective. It is argued that the scientific literature concerning music contains two different methodological approaches which significantly determine the range of possible conclusions to be reached by the research. The approach „from the outside“ investigates music by automatically applying to music the more general conclusions concerning human cognition and other capacities and behaviors. Thus, this approach omits music’s internal factors. In contrast, the approach „from within“ consists in empirically (...) investigating reactions to music, capacities necessary for its understanding, performing, etc., and their relationships with the reactions and capacities outside the domain of music. The paper shows that, even though the scientific research of music is still in the beginning stage, the approach from within enables more complete explanations concerning music, due to taking into account a larger number of factors relevant for philosophical understanding of the phenomenon of music. The book Phenomenology of Plurality: Hannah Arendt on Political Intersubjectivity is a contribution not only to the phenomenological tradition of thought and Hannah Arendt studies, but also political science and, most importantly, political philosophy. This paper discusses a novel problem at the intersection of ethics and epistemology: there can be cases in which moral considerations seem to "encroach'' upon belief from multiple directions at once, and possibly to varying degrees, thereby leaving their overall effect on belief unclear. We introduce these cases -- cases of moral encroachment under moral uncertainty -- and show that they pose a problem for all predominant accounts of moral encroachment. We then address the problem, by developing a modular Bayesian (...) framework that, we argue, is sufficiently flexible and scaleable to accommodate the multifaceted uncertainty we describe while still generating clear recommendations for an agent's beliefs. Our framework has several practical upshots, and we close by articulating them: we derive insights about the relationship between moral character and doxastic behavior and make suggestions for how to encourage people to revise their doxastic states in morally laudable ways, without deviating from core Bayesian norms. Certain characteristics make machine learning a powerful tool for processing large amounts of data, and also particularly unsuitable for explanatory purposes. There are worries that its increasing use in science may sideline the explanatory goals of research. We analyze the key characteristics of ML that might have implications for the future directions in scientific research: epistemic opacity and the ‘theory-agnostic’ modeling. These characteristics are further analyzed in a comparison of ML with the traditional statistical methods, in order to demonstrate what (...) it is specifically that makes ML methodology substantially unsuitable for reaching explanations. The analysis is given broader philosophical context by connecting it with the views on the role of prediction and explanation in science, their relationship, and the value of explanation. We proceed to show, first, that ML disrupts the relationship between prediction and explanation commonly understood as a functional relationship. Then we show that the value of explanation is not exhausted in purely predictive functions, but rather has a ubiquitously recognized value for both science and everyday life. We then invoke two hypothetical scenarios with different degrees of automatization of science, which help test our intuitions on the role of explanation in science. The main question we address is whether ML will reorient or otherwise impact our standard explanatory practice. We conclude with a prognosis that ML would diversify science into purely predictively oriented research based on ML-like techniques and, on the other hand, remaining faithful to anthropocentric research focused on the search for explanation. Teza o "neskrivljenom neznanju" je instrument u okviru teorije pravednog rata koja sluzi da se moralno opravda ucesce u ratu za pripadnike one strane koja je porazena; uslovi za neskrivljenost su da su porazeni borci iskreno verovali da brane pravednu stvar i da su takodje iskreno verovali da imaju nekih izgleda da pobede. Bez ovog instrumenta teorija pravednog rata, jedna teorija koja opravdava rat preko pravednog uzroka rata, bi porazenoj strani narocito ako je slabija, morala da unapred pripise krivicu sto (...) je uopste usla u rat. Medjutim, u savremenoj situaciji rasirene kriminalizacije rata sam pojam rata se menja i postaje izuzetno neodredjen. Kako ratovi postaju sve vise i vise "asimetricni", pre svega u snazi sukobljenih strana, cini se da se teorija pravednog rata suocava sa teskocom da u svoje okvire uopste situira "neskrivljeno neznanje", ali to povlaci teskocu te teorije da pokaze da pravda ide sa pobedom, otvarajuci tako pitanje artikulacije pravednog mira. Bas Van Fraassen is a nifty philosopher of science. He received his PhD in Pittsburgh in 1966, under the guidance of Adolf Grünbaum, he taught at Yale University, the university of Toronto, the University of Southern California, he has been McCosh Professor of Philosophy in Princeton, and eventually joined the department of philosophy at San Francisco State University, where he has the title of Distinguished Professor of Philosophy. He first gained attention with his book An Introduction to the Philosophy of (...) Time and Space where he tried to develop a formal theory of space and time based on the notion of causality. The book had an enormous legacy, with experts of the likes of John Earman and David Malament joining the debate. However, he achieved V.I.P. status with his classic The Scientific Image, where he defends a combination of empiricism and antirealism towards unobservable entities based on a re-definition of what the scientific enterprise is. His last achievement is the tome Scientific Representation: Paradoxes of Perspectives, where he combines his scientific empiricism with the view that theories are best thought as models or structures, rather than sets of sentences. In this interview, we talk about his philosophical influences and the birth of The Scientific Image during a journey through North-Africa, Turkey and Eastern Europe, we talk about saving the phenomena and suspending judgement over the existence of unobservable entities, living in world full of mysteries and leaving unanswerable questions unanswered, rationality and irrationality, living in a simulation, the historical interplay between theorizing and experimenting, the meaning of particle detectors for an empiricist, the unity of science and physicalism, the condemnation of Galilei by the Church, and the distinction between Appearance and Reality…. This book offers an ability-based view of mental disorders. It develops a detailed analysis of the concept of inability that is relevant in the psychiatric and psychotherapeutic context by drawing on the most recent literature on the concepts of ability, reasons and harm. What is it to have a mental disorder? This book contends that an individual has a mental disorder if and only if (1) they are-in the relevant sense-unable to respond adequately to their available (apparent) reasons in their (...) thinking, feeling or acting and (2) they are harmed by the condition underlying or resulting from that inability. The author calls this the "Rehability View". This view can account for what is "mental" about mental disorders: it is the rational relations among an individual's attitudes and actions that is "disordered", and the relevant norms are the norms of reasons. This view is compatible with explanations of mental disorders in terms of biological dysfunctions, without reducing the former to the latter. The aim is not to offer just another conception of mental disorder, but to develop a systematic approach that incorporates insights from philosophy of psychiatry and adjacent philosophical disciplines. Human rights do not represent an absolute truth. Otherwise, they would represent ideology, which is contradictory to the basic idea of human rights itself. Consequently, there is a need for redefinition of the main presuppositions of modern conception of human rights represented in the Universal Declaration of Human Rights. This paper argues that Rawls's conception of human rights is significant for the refiguration of human rights. Caso contrário, eles representariam a ideologia, o que é contraditório em relação à própria idéia básica de direitos humanos. Consequentemente, há uma necessidade de redefinição dos pressupostos principais da moderna concepção de direitos humanos representada na Declaração Universal dos Direitos Humanos. Esse artigo argumenta que a concepção de Rawls de direitos humanos é importante para a reconfiguração dos direitos humanos. For some time now, certain theorists have been urging us to move beyond text-based understandings of culture to consider the impact of new media on the structure and organization of knowledge. This article, however, reconsiders the usual priority given to digital media by comparing Wikipedia, the free, user-led online Encyclopedia, with Diderot and D'Alembert's eighteenth-century Encyclopédie. It begins by suggesting that the dichotomy between information system and text is not sufficient for describing the differences between the two. It then considers (...) more closely the type of critical thinking presupposed by the Encyclopédie. It concludes by raising the question of the role of judgement in making sense of any encyclopedia in a modern world in which knowledge systems only coexist on the condition of being partially blind to one another. Problemi identiteta i razlike u okviru politicke teorije artikulisani su u vidu spora koji se od uspostavljanja liberalnih demokratija intenzivira, spora o nacinu na koji se politicka zajednica uspostavlja i opravdava, u relaciji sa pitanjem odnosa pojedinca i kolektiva. Rad analizira najaktuelnije refleksije evropske politike na problem razlike i verovatnost teze o kraju multikulturalizma koja se cula na konferenciji za bezbednost odrzanoj u Minhenu 2011. godine, kroz objasnjenje geneze problema i razmatranje ponudjenih resenja. Pored toga, rad obrazlaze pojam moderne drzave (...) kroz principe gradjanstva i nacije u relaciji sa pitanjem identiteta i razlike, sa posebnim akcentom na konceptima neutralnosti i tolerancije kao kljucnim tackama u sporu. Kao zakljucak, iznose se razlozi zasto problem razlike ne moze tako lako da bude prevazidjen i na koji nacin diskurzivna demokratija potencijalno moze da bude buduca smernica za drugaciji fokus spora. The position of animals in theoretical imagination and society stems from the historical naturalization of basic epistemological and ontological categories, the complex socio-cultural genesis of concepts whose assumptions are not easy to unravel nowadays. The given understanding of subjectivity and sociability entails nature as its opposite, but also that all other categories in border classification areas are a priori subordinate to human interests and goals. The debates that took place during the 1970s and 1980s, when it comes to animal rights (...) movements and the ecofeminist movement, have made some sort of confusion in the then accepted approach to this issue. However, only recently has the current biopolitical theory, by posing the question of human determinism and taking into account the conceptual breakthroughs related to the boundary between biological species, established in modern discourse, brought significant innovations in the debate on vegetarianism. In order to explain the shifts that can be made in the debate in the area that opened up with biopolitical theory, two arguments that have dominated the debate for a long time – ethically and ecofeministically – are subjected to critical analysis. While the ethical and ecofeminist standpoints are focused on the categories of political subjectivity and anthropocentric assumptions, biopolitics raises the issue of overcoming the deep ambivalence of normative and practical solutions that characterize the human attitude towards animals and their planned and systematized killing for the requirements of the food industry. The main goal in the article is to develop a definition of the morality as the subject of study for ethics, a part of philosophy dealing with the nature and the scope of possible application of morality as a specific evaluational criterion. Some basic features of this specificity have been explored, and a list of ethical theories have been briefly analyzed, two of them in some more details.
